Justice Department’s request will not be followed.
On Monday, a federal appeals court in Washington, D.C. announced that it would be rejecting a request to dismiss the case against Michael Flynn that was requested by the Department of Justice. Michael Flynn was President Trump’s former national security adviser and is being charged with lying to the FBI, a charge he has pled guilty to.
The U.S. District Judge Thomas Griffith wrote a concurring opinion for the court saying, “Today we reach the unexceptional yet important conclusion that a court of appeals should stay its hand and allow the district court to finish its work rather than hear a challenge to a decision not yet made. That is a policy the federal courts have followed since the beginning of the Republic.”
